I can only assume that they weren't formally arrested until they were within the jurisdiction of the Court.

Although, judging by the type of badge-chaser who joins ICE, I wouldn't be at all surprised if they do voluntarily present evidence that they've engaged in kidnapping and human trafficking to a Court of Law.

Despite US law generally frowning on that sort of thing, since about Juneteenth 1865.

However Big Tech's decision to adopt the No Nipples Rule could well be an example of State-Absent Totalitarian Capitalism. Where there are no checks on the power of Corporations. Rather like in the Captaincies before the locals got all nibbly. Or in the time of the Robber Barons during the US' Gilded Age. A small group of very rich people who own the infrastructure got together and decided this is the rule we have to live by now. Not only didn't we tell them to introduce that rule we probably don't even know who they are.
