The Proportionality Test is the weighing of a legitimate military objective against the harm to civilians. The military objective always has priority. There is no level of harm to civilians which prevents the military objective being achieved.

I don't doubt that he'd be much further along in a whole host of areas if only he was able to give some hint that he was capable of understanding and engaging on the issues.
