When you allow a belligerent which systematically feigns non-combatant (civilian) status and systematically feigns the use of protective emblems such as those of the ICRC and the UN.

It's almost impossible to have any faith in a white flag.

This issue is actually a major part of the plot of; "Generation Kill." The jokes about me being really good with a SAW and getting the right hump.

In the; "Screwby" episode they're sent to attack an airfield. On the way there they're attacked by friendly fire, from a medical unit, causing them to lose their supply truck with their food and ammunition.

Thinking they're going up against tanks with lightly armoured Humvees battalion command changes the Rules of Engagement (RoE). Declaring a free fire zone, where everything can be shot whether it's posing a threat or not. As the US did in the actual First Battle of Fallujah (2004).

The squad leaders all ignore the order. Deciding not to pass it along.

As they attack the Squad Automatic Weapon operator in "Iceman's" squad thinks he sees enemy fighters so asks Iceman permission to open fire. Distracted by a jammed main gun Iceman gives it.

It turns out the enemy fighters are actually teenage Bedouin boys with their camels. All of whom are killed.

For this the SAW operator earns the nickname; "Whopper Jr." As in; " Burger King (BK) - Baby Killer. " The investigation looms over the battalion throughout the rest of its mission.

In the next episode; "Combat Jack" they're manning a checkpoint. The RoE say they have to fire a warning shots at approaching vehicles before opening fire. 

Two vehicles approach, they fire warning shots and after they're ignored they open fire, killing unarmed civilians. After this happens for a second time one of them wonders;

"Do you think they know what our warning shots mean?!"

In the next episode; "A Burning Dog" they're again manning a checkpoint. However the RoE have changed. They're now to fire an M203 smoke grenade near approaching vehicles. If that's ignored they can open fire.

They try it once and it works. They try it a second time and Whopper Jr, thinking it is being ignored, decides to open fire. Everyone else joins in. Killing unarmed civilians.

In the next episode; "Stay Frosty" they're again manning a checkpoint. They fire a smoke grenade at an approaching vehicle. However this time it kicks up off the ground hitting a civilian they've just given humanitarian aid to in the head, killing him instantly.

The reaction is them all having this sense that no matter what they do, they just can't win.

All that said though. 

It looks like someone is going to be prosecuted over this one. Along with anyone else in any other instance where someone waving a white flag has been fired upon.
