Although I am being asked to assess a law which has yet to been fully written. Even without the Reasonableness Doctrine Israel will still be able to carry out Judicial Review of Apparatus of State such as the military and non-judicial Tribunals.

While a military Court Martial is properly referred to as a; "Military Tribunal" it is a Judicial Tribunal, a Court. It's findings are almost automatically reviewed by a Judicial Authority. Another Court.

The Laws of War and Crimes Against Humanity over which the ICC has jurisdiction are Statutory Law. They are clearly written down. Whether Israeli Courts are unwilling or unable to prosecute criminal violations of those clear Statutory Laws, thus giving the ICC jurisdiction. That has absolutely nothing to do with the grounds on which Israel is able to conduct Judicial Review over Apparatus of State. 

The imperfect experiment which is the ICC simply needs a prima facie example of one of those Statutory Laws being broken along with an Israeli failure to prosecute. Although the ICC is intended to resolve conflicts rather than cause them. If things were to get that far then why Israel is failing to prosecute is really no concern on the ICC.

I don't think Pardo cares one bit whether public transport runs on Yom Kippur or not. However the audi alteram partem element of Natural Justice means that even without the Reasonableness Doctrine the decision can still be subjected to Judicial Review. If one side of the debate feels its views have not been properly heard and considered.

I have to admit that I am not familiar with the specific by-laws governing public transport providers in Bnei Brak. However if they don't contain a clause laying out the Statutory Duty by which consultations on changes to services on the Sabbath and other Jewish holidays are to be heard and weighed. It is easy enough to add one.




I really would've expected a former Mossad head to know better than to invoke the, currently rather ketchupy, ICC.
