No Elections Ever Again?
I honestly think we should stop reporting that the UK Supreme Court has delivered its ruling on the prorogation of Parliament.
It is going to make it much harder for them when they recover their senses and ask for a do-over.
If applied retroactively today's, well outburst, means that Britain has not had a functioning government since at least 1997. Meaning there was no legal mechanism to establish the Supreme Court.
Even if only applied moving forward it still causes a massive constitutional crisis.
It has overturned an Order of Council.
An Order of Council is the only mechanism by which the House of Commons can be dissolved and a General Election can be held.
At worst the Supreme Court has declared that there is no mechanism by which a General Election can be called.
At best it has declared that MP's who do not wish to submit themselves to re-election can simply refuse and overturn the calling of a General Election.
At least now though everyone finally understands the phrasing in the Withdrawal Agreement which reads;
"Competent British Courts."
